NYSTLI Dean Anthony Pirrotti, Jr., Esq., hosts a Discussion with the celebrated Trial Attorney Ben Rubinowitz, Esq.; Trial Judge Paul. I. Marx; and Defense Attorney Alfred Vigorito, Esq.

 

Ben and his Law Firm handled a complex Stroke case of a 41 year old who was working, married with children, and, due to claimed malpractice, ended up in a Nursing Home unable to care for himself and his family. Issues to be discussed is the development of this malpractice case, the medicine and defenses, along with discussing the discovery, depositions and Motions in Limine, and how important pleadings and Expert Responses are (for plaintiff and defendant) and how these issues impacted the Trial. We will discuss jury selection, binding statements/omissions during jury selection/openings, cross examination (of plaintiff and defendant witnesses); dismissal of third party defendant; how “attacking” a witness’s can back-fire; making the defendant Doctor your Expert; newly asserted cross-claim at Trial; understanding 50-A and 50-B; Loss of Chance; value of loss of consortium claim; directed verdict against a defendant; defendants pointing fingers at each other; the Verdict Sheet; the Economist and establishing financial loss; read backs and their influence; high-low agreements; the impact of the credible Trial Lawyer upon the jury; Summations, and, importantly, how to ask a Jury for $120 Million dollars!
