New York's most recent budget contained several provisions that have significantly changed the landscape of automobile accident litigation.
This plaintiff-focused CLE will examine the practical impact of these sweeping changes on personal injury practice, including the revised definition of "serious injury," the elimination of the 90/180-day category, the new modified comparative negligence standard, limitations on non-economic damages for certain plaintiffs, expanded insurance fraud provisions, and how insurers are expected to implement these reforms. This CLE will also address the recent Department of Financial Services guidance on these provisions.
This program will cover the immediate litigation implications, anticipated defense strategies, and practical considerations for representing injured plaintiffs under the new statutory framework.

- Elimination of the 90/180-day serious injury category
- Changes to proving serious injury and trial sequencing
- New modified comparative negligence rule and its impact on recovery
- $100,000 cap on non-economic damages in certain cases
- Department of Financial Service's recent guidance (Insurance Circular Letter No. 3 - 2026)
