ETHICS: SOCIAL MEDIA DO'S & DON'TS

Wednesday, June 28, 2017

3 ETHICS CREDITS

Lawyers are now facing certain new challenges on a daily basis – those involving electronic discovery issues.  The use of email, social media and other electronic means have significant implications for our clients and their cases.

This panel will use a factual  scenario to examine various ethical issues that arise in the electronic world in which we live and litigate, including but not limited to: social media; inadvertent disclosure of confidential information; use of spyware; false evidence; discovery issues; and trial consequences. Applying the New York Rules of Professional Conduct, precedent and bar association opinions, we will explore the applicable practical and ethical concerns that come into play when these issues arise.

In addition, the panel will discuss developments in the lead case Galasso and its recent implications for civil liability.  In doing so, we will review the “best practice” scenario for attorneys as it relates  to a lawyer’s fiduciary responsibilities and reasonable reliance on others.
