This program is geared toward identifying problematic issues and offering ways in which they can be dealt with so that major hurdles can be overcome during the course of litigation and trial. • Limited proof to confirm your client’s injuries • Proof of brain injury in the absence of strong visual evidence of same • Dealing with psychiatric and other complicated histories • Proving the magnitude of RSD or TBI in the face of limited available proof • Confronting credibility issues such as criminal history or multiple histories in records • Proof in Transit cases in the absence of forthcoming discovery • Proof of liability in Erbs Palsy cases where same is not documented in hospital record • Do’s and don’t’s in proving damages in soft tissue auto cases – a defendant’s perspective • Labor Law 240(1), 241(6) and 200 from the defense perspective – pitfalls plaintiffs should avoid and how to overcome them
